Delayed Birth certificate You can also apply for a Delayed US Birth Certificate instead of submitting a Letter of No Record. This is a birth certificate that is filed for after one year of your birth. You can instead submit a Delayed U.S. Birth Certificate on the condition that it lists documentation that you used to apply for it and a sign from either an attendant who was present at the time of your birth or an affidavit that has a signature from your parents. Birth of US citizens abroad If you were born in a foreign country and do not have a Consular Report of Birth Abroad or a Certificate of Birth on file- then the Department of State has the following rules you should follow- If you claim citizenship via birth abroad to one US citizen parent, then you’ll need 1) a foreign birth certificate 2) Proof of citizenship of the parent who is a US citizen 3) An affidavit of your parent who is the US citizen. These documents need to display all periods and the physical presence or places of residence in the United States as well as in the foreign country before your birth. If you claim citizenship via birth abroad to two US citizen parents, then you’ll need 1) Your foreign birth certificate 2) your parent’s marriage certificate and 3) a proof of citizenship of your parents. An affidavit of your parents (who have US citizenship) displaying all periods, places of residence or physical presence in the US and abroad before your birth is also required. You must also remember that documents like voter register id, social security card and army discharge paper would not be accepted as a substitute for US birth certificate when you apply for the US passport.
