If you are applying for a US passport, the American government has a strict policy that requires all new passport applicants to include a proof of citizenship along with other documentation needed for passport. Generally, the proof of citizenship is an original issued-by-government birth certificate with a raised seal or a naturalization document.
If you do not have the original copy of your birth certificate or your child’s birth certificate, there are a number of alternatives that you can use to as essential proof of your US citizenship. Here is the list of documents that you can use instead of a birth certificate. Missing birth certificate passport requirements A Letter of No Record ‘A Letter of No record’ is issued by the government. This document includes your name, date of birth and the timeline of which years were searched for a birth record and the fact that there is no birth certificate on the file for you. This is proof that there is no record of your birth in the US and you’ll need this to send it with your passport application. In order to get the Letter of No Record, you will need to have a meeting with a government official of the state where you were born and get an appointment with their Dept. of Vital Statistics- this is the only department who will be able to issue this letter. They will search their database and see if your birth is on the record. If it’s not, then you’ll be provided with a Letter of No record. This process will probably take a week. Once you’ve gotten the Letter of No Record then you can start gathering additional documents as evidence of your citizenship. These are referred to as “Early Public Records”. You also have to make sure that these documents show your name, date/place of birth and that they were created within the first five years of your life. Form DS 10: Birth Affidavit If you are US-born and don’t have a birth certificate to submit with your passport application- you may submit the Form DS-10 or you may submit a Birth Affidavit as evidence of your US citizenship. Make sure that the birth affidavit is notarized, submitted in person with Form DS-11 and together with all the ‘Early Public Records’. It must also be completed by an affiant who has personal knowledge of the birth in the US and must state shortly how the affiant’s knowledge was acquired. It should be completed by an older blood relative (if a relative is not available then it can be done by the attending physician or anybody with personal knowledge of your birth). You may also submit the Affidavit if Birth form DS-10 from an older blood relative like a sibling, uncle, aunt or parents who have the knowledge of your birth. It must also be notarized or sealed and have a signature of the acceptance agent. Delayed Birth certificate You can also apply for a Delayed US Birth Certificate instead of submitting a Letter of No Record. This is a birth certificate that is filed for after one year of your birth. You can instead submit a Delayed U.S. Birth Certificate on the condition that it lists documentation that you used to apply for it and a sign from either an attendant who was present at the time of your birth or an affidavit that has a signature from your parents. Birth of US citizens abroad If you were born in a foreign country and do not have a Consular Report of Birth Abroad or a Certificate of Birth on file- then the Department of State has the following rules you should follow- If you claim citizenship via birth abroad to one US citizen parent, then you’ll need 1) a foreign birth certificate 2) Proof of citizenship of the parent who is a US citizen 3) An affidavit of your parent who is the US citizen. These documents need to display all periods and the physical presence or places of residence in the United States as well as in the foreign country before your birth. If you claim citizenship via birth abroad to two US citizen parents, then you’ll need 1) Your foreign birth certificate 2) your parent’s marriage certificate and 3) a proof of citizenship of your parents. An affidavit of your parents (who have US citizenship) displaying all periods, places of residence or physical presence in the US and abroad before your birth is also required. You must also remember that documents like voter register id, social security card and army discharge paper would not be accepted as a substitute for US birth certificate when you apply for the US passport.
